The National Defense Authorization Act is the Greatest Threat to Civil Liberties Americans Face

If Obama does one thing for the remainder of his presidency let it be a veto of the National Defense Authorization Act – a law recently passed by the Senate which would place domestic terror investigations and interrogations into the hands of the military and which would open the door for trial-free, indefinite detention of anyone, including American citizens, so long as the government calls them terrorists.

So much for innocent until proven guilty. So much for limited government. What Americans are now facing is quite literally the end of the line. We will either uphold the freedoms baked into our Constitutional Republic, or we will scrap the entire project in the name of security as we wage, endlessly, this futile, costly, and ultimately self-defeating War on Terror.

An Open Letter from America’s Port Truck Drivers on Occupy the Ports

We are the front-line workers who haul container rigs full of imported and exported goods to and from the docks and warehouses every day.

We have been elected by committees of our co-workers at the Ports of Los Angeles, Long Beach, Oakland, Seattle, Tacoma, New York and New Jersey to tell our collective story. We have accepted the honor to speak up for our brothers and sisters about our working conditions despite the risk of retaliation we face. One of us is a mother, the rest of us fathers. Between the five of us we have 11children and one more baby on the way. We have a combined 46 years of experience driving cargo from our shores for America’s stores.

We are inspired that a non-violent democratic movement that insists on basic economic fairness is capturing the hearts and minds of so many working people. Thank you “99 Percenters” for hearing our call for justice. We are humbled and overwhelmed by recent attention. Normally we are invisible.

Today’s demonstrations will impact us. While we cannot officially speak for every worker who shares our occupation, we can use this opportunity to reveal what it’s like to walk a day in our shoes for the 110,000 of us in America whose job it is to be a port truck driver. It may be tempting for media to ask questions about whether we support a shutdown, but there are no easy answers. Instead, we ask you, are you willing to listen and learn why a one-word response is impossible?

ROLL OVER..


With the uncertainty of the future of the US Dollar – I’ve been considering the absolute withdrawl of any type of future financial “security” strategies.  For those of you who do not have a 401K, IRA, IRA Roth, etc – you need not read the rest of this entry. My sentiments harkens back to 1999 –  when Buenos Aires experienced the biggest financial crisis I’ve seen. I had a really good friend in Buenos Aires going though this while I was living quite comfortably receiving annual bonus’ amounting between $10K – $20K (before taxes). Through my friend, I realized how dire the economic situation it was. I’d receive stories from her attempting to recoup her money she had at the bank (both in an account and a safety deposit box). How all the banks essentially locked down all their branches – not allowing any of their customers to access their valuables and money. Imagine your whole savings being taken away just like that. Yes we have the FIDC…but when the government and the banking systems are in dire straits – guess who’s going to get fucked. Corporate Execs do this all the time and get away with it (ENRON?).

How certain are we that our 401K, ROTH or whatever smokescreen the banks put up are full proof? And when I am able to access my miniscule amount of “investments” what makes me think that THAT amount be enough for the inevitable bloated cost of living that we know is going to happen in 25 yrs. My partner advised me to withdraw all my cash and invest in gold…yet again another uncertainty..(you should google “gold investment”). Hmm…does anyone have any recommends? Continue reading

If you haven’t moved your money out of the big banks yet, NOW IS THE TIME! Wells Fargo just notified its customers that as of February 15, 2012:

“YOU AGREE THAT YOU AND THE BANK ARE WAIVING THE RIGHT TO A JURY
TRIAL OR TRIAL BEFORE A JUDGE IN A PUBLIC COURT.”

Effective February 15, 2012

Important Change in Terms Notice
Dispute Resolution Program: Arbitration Agreement
This Addenda amends the Consumer Account Agreement (“Agreement”). All terms
defined in the Agreement will have the same meaning when used in this Addenda.
If there is a conflict between the addenda and the Agreement, this Addenda will
control. Except as expressly amended by this Addenda, the Agreement remains in full
force and effect.

Binding arbitration
If you have a dispute with the Bank, and you are not able to resolve the dispute informally, you and the Bank agree that upon demand by either you or the Bank, the dispute will be resolved through the arbitration process as set forth in this part. A “dispute” is any unresolved disagreement between you and the Bank. It includes any disagreement relating in any way to services, accounts or matters; to your use of any of the Bank’s banking locations or facilities; or to any means you may use to access your account(s). It includes claims based on broken promises or contracts, torts, or other wrongful actions. It also includes statutory, common law, and equitable claims.
“Disputes” include disagreements about the meaning, application or enforceability of this
arbitration agreement. This arbitration agreement shall survive any termination of your
account(s). YOU AGREE THAT YOU AND THE BANK ARE WAIVING THE RIGHT TO A JURY TRIAL OR TRIAL BEFORE A JUDGE IN A PUBLIC COURT.

As the sole exception to this arbitration agreement, you and the Bank retain the right
to pursue in small claims court any dispute that is within that court’s jurisdiction. If either you or the Bank fail to submit to binding arbitration following lawful demand, the party so failing bears all costs and expenses incurred by the other in compelling arbitration.
Arbitration procedure; severability You or the Bank may submit a dispute to binding arbitration at any time, regardless of whether a lawsuit or other proceeding has been previously commenced. NEITHER YOU NOR THE BANK SHALL BE ENTITLED TO JOIN OR CONSOLIDATE DISPUTES BY OR AGAINST OTHERS IN ANY ARBITRATION, OR TO INCLUDE IN ANY ARBITRATION ANY DISPUTE AS A REPRESENTATIVE OR MEMBER OF A CLASS, OR TO ACT IN ANY ARBITRATION IN THE INTEREST OF THE GENERAL PUBLIC OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. Each arbitration, including the selection of the arbitrator(s) shall be administered by the American Arbitration Association (AAA), or such other administrator as you and the Bank may mutually agree to (the AAA or such other mutually agreeable administrator to be referred to hereinafter as the “Arbitration Administrator”), according to the Commercial Arbitration Rules and the Supplemental Procedures for Consumer Related Disputes (“AAA Rules”). To the extent that there is any variance between the AAA Rules and this Arbitration Agreement, this Arbitration Agreement shall control. Arbitrators must be members of the state bar where the arbitration is held, with expertise in the substantive laws applicable to the subject matter of the dispute. No arbitrator or other party to an arbitration proceeding may disclose the existence, content or results thereof, except for disclosures of information by a party required in the ordinary course of its business or by applicable law or regulation. The parties agree that in this relationship: (1) The parties are participating in transactions involving interstate commerce; (2) The arbitrator shall decide any dispute regarding the enforceability of this arbitration agreement; and (3) This agreement and any resulting arbitration are governed by the provisions of the Federal Arbitration Act (Title 9 of the United States Code), and, to the extent any provision of that act is inapplicable, unenforceable or invalid, the laws of the state that govern the relationship between you and the Bank. If any of the provision of this arbitration agreement dealing with class action, class arbitration, private attorney general action, other representative action, joinder, or consolidation is found to be illegal or unenforceable, that invalid provision shall not be severable and this entire arbitration agreement shall be unenforceable.

Rights preserved
This arbitration agreement does not prohibit you or the Bank from exercising any lawful
rights or using other available remedies to preserve, or obtain possession of property;
exercise self-help remedies, including setoff rights; or obtain provisional or ancillary
remedies such as injunctive relief, attachment, garnishment or the appointment of a
receiver by a court of competent jurisdiction. All statutes of limitations applicable to any
dispute apply to any arbitration between you and the Bank. The provisions of this
arbitration agreement shall survive termination or amendment of the deposit relationship
or any other relationship between you and the Bank.

Fees and expenses of arbitration
Arbitration fees shall be determined by the rules or procedures of the arbitration
administrator, unless limited by applicable law. Please check with the arbitration
administrator to determine the fees applicable to any arbitration you may file. If the
applicable law of the state in which you opened your account limits the amount of fees and expenses to be paid by you, then no allocation of fees and expenses to you shall exceed this limitation. Unless inconsistent with applicable law, each of us shall bear the expense of our own attorney, expert and witness fees, regardless of which of us prevails in the arbitration.

U.S. citizens could be held by military without charge

It’s interesting to note how our rights as U.S. citizens are eroding. The Senate recently passed a bill which would allow a sitting U.S. president to declare the U.S. a “battlefield” and to have American citizens detained by the military indefinitely without charge. They would not be “required” to do so, but they would be allowed. Language has been tightened up so as to only include “terrorists,” but if you happen to be detained without charge on scant evidence, what are the chances of proving yourself innocent?

Yo Voy Con La Sexta!

I was doing some Christmas shopping on the Schools for Chiapas web site and came across a number of items, like the t-shirt above, with the phrase “Yo voy con la Sexta” on them. Google translate revealed that “la sexta” means “the sixth”, and so the phrase translates as “I go with the Sixth”. With a little more searching I found that “the Sixth” refers to the Sixth Declaration Of The Lancandon Jungle (Sexta Declaración de la Selva Lacandona). The Lacandon Jungle is in Chiapas and it was here that in 2005 the Zapatista National Liberation Army (Ejército Zapatista de Liberación Nacional, EZLN) released its sixth manifesto. In this Sixth Declaration, among other principals, the EZLN declare their support for the oppressed peoples of Mexico and solidarity with the alter-globalization movement.

The Declaration discusses capitalism in some detail, includiing: “….capitalism also makes its wealth from plunder, or theft, because they take what they want from others, land, for example, and natural resources. So capitalism is a system where the robbers are free and they are admired and used as examples.”

We are all Marxists

 

 

I just finished reading David McLellan’s monumental biography of Karl Marx. It’s a fascinating account of Marx’s life and work set against the volatile political and economic backdrop of 19th Century Europe. It’s incredible how he (and his family) endured through years of poverty, privation, and ill health to produce a monumental philosophy that attempts to explain the fundamental economic workings of society. Marx’s weaving of history, philosophy, sociololgy, science and of course economics has profoundly affected the way we all see the world; so that in a sense we are all now Marxists.

Frame Capitalism not the Earth

We in the west think that Darfur was torn apart due to ethnic conflict, while according to David Morse it was a resource war. He writes in an insightful article on Alternet,

“The most sophisticated technologies deployed are, on the one hand, the helicopters used by the Sudanese government to support the militias when they attack black African villages, and on the other hand, quite a different weapon: the seismographs used by foreign oil companies to map oil deposits hundreds of feet below the surface.”

Why are the dots never connected between the wars in Darfur and exploitation by the oil industry? Morse points to the undeniable subsidies provided to media by the automobile industry… think of the slickest and most fantasy driven ads: the car ads.

The ideology that dominates our media is so strong that alternative narratives are taken with a minimum of seriousness, as Slavoj Zizek points out, without the necessity of the kind of prohibition of films dealing with time travel and alternate history as happened in China in April 2011 where even a fantasy escape into an alternate reality is considered too dangerous. But — try to imagine another system here in the US? Zizek again:

“It is easy for us to imagine the end of the world – see numerous apocalyptic films, but not end of capitalism.”

Meanwhile, in Durban, the climate talks are once again lumbering towards failure, while those protesting outside the talks seem to have a good understanding of the criticality of ideological framing. Democracy Now reported that Pablo Salon, former ambassador to the UN from Bolivia and chief climate negotiator for Bolivia, who had been on the inside of the talks at both Copenhagen and Cancun said,

“And I’m here in the outside because I think the only way that we are going to be able to change the course of these negotiations is here in the outside. If people mobilize like we are seeing now in all countries, in a broader perspective, that’s the only way we are going to be able to have deep cuts of emissions, because what they are now promoting is a new mandate to do nothing until 2020, while the world is going to burn and Africa is going to be cooked for an increase in the temperature of more than four to six degrees Celsius.”

When asked how the US fits into this he answered:

“Oh, the U.S., I would say, it’s really a shame, because their proposal on the table is only an emission reduction of 3 percent, 3 percent, of the levels of emissions of 1990, and to do that until 2020. So that is mainly “let’s do nothing in relation to climate change,” when it comes to emission reductions of the country that historically has the biggest emission reductions during the past 250 years.”

Given the manipulation of the Copenhagen climate talks by the US State department as reported by John Vidal on Democracy Now last year, we should be seeing some more progressive re-framing of the issues by Vidal as he has just traveled to Durban “from Africa’s poorest nations, Malawi; its newest, Southern Sudan; its hungriest, Ethiopia” as Amy Goodman put it.

Since the right wing in the US always wants everything to be “paid for” I was marginally heartened to find Vidal telling Goodman this weekend this in answer to her question why he thinks “it would serve the U.S. economy, as opposed to why so many in the United States are saying we can’t do anything about a global climate fund because we are dealing with a broken economy in the United States?:

“This is not going to cost America anything at all, actually. It’s going to—America could take the world lead very, very easily. It could switch just like that. It could become absolutely the hero of these talks. It’s chosen not to. It hasn’t changed its position in three years.”

But – here in the US, it is business as usual. In fact, Fox Business blames the new Muppet movie and its predecessors for the Occupy Wall Street movement. The Huffington Post reported that Dan Gainor of the conservative Media Research Center said,

“Whether it was ‘Captain Planet’ or Nickelodeon’s ‘Big Green Help,’ or ‘The Day After Tomorrow,’ the Al Gore-influenced movie, all of that is what they’re teaching, is that corporations is bad, the oil industry is bad, and ultimately what they’re telling kids is what they told you in the movie ‘The Matrix’: that mankind is a virus on poor old mother Earth.”
